Consumer Information Collection / Opt-Out
YCTV, directly and/or through its affiliates, provides its customers, that may include Hotels, Convention and Visitors Bureaus and local merchant advertisers, (herein referred to as "Customers") with tools that have the ability to collect end consumer ("Consumer") information (herein referred to as Personal Information or "PI").
When Consumers utilize certain e-mail, text message and "offer download" features within the YCTV product, YCTV collects PI such as sender name, sender email address, recipient name, recipient e-mail address, and mobile phone numbers.
The PI Consumers provide and the PI YCTV obtains about them may be used:
- To provide Customer or YCTV information expressly requested by the Consumer;
- To transmit promotions and special offers expressly requested by the Consumer ;
- To send other future Customer product information, promotions and offers to the Consumer.
- For other purposes expressly communicated to Consumers at the time they
provide their PI.
When Consumers enter their mobile number in YCTV to have YCTV information and videos forwarded to their mobile phone,or enter their e-mail addresses or the e-mail addresses of friends, family or associates, Â they are giving implied consent to YCTV to send them the requested information or send information on their behalf to friends, family or associates. While this Consumer data is collected and aggregated by YCTV for analytical and reporting purposes, YCTV will not use that data for contacting the Consumer for any other purpose, nor will it share, sell or rent that information with any other party for promotional use.
When Consumers text their mobile number to YCTV to request delivery of a Customer’s special offer or promotion, they are opting-in their mobiles phones to join a Customer’s YCTV distribution list(s). They are also giving implied consent for Customer’s (or YCTV as a delivery agent) to send them text messages and to allow Customers (or YCTV as a delivery agent) to view and access their mobile phone numbers. The text messages Customer’s send can be for the current requested promotion, or for other future promotions. A Consumer can remove their mobile phone number from a Customer database at anytime by typing the word "Remove" and replying to any text message they receive from YCTV.
NOTE: Receiving mobile text messages from YCTV is completely FREE of charge to the consumer; however, standard text messaging rates from wireless providers still apply.
In the course of conducting its business, YCTV collects PI from Customer’s who want information about YCTV products or services, and from Customers or Consumers who want to be apprised of the launch of a new YCTV destination. YCTV will use this PI for contacting customer and/or transmitting of the requested information. YCTV may also use e-mail addresses for future communications with the Consumer or Customer. Any Customer or Consumer may remove their e-mail address from YCTV lists by typing the word "Remove" and replying to the e-mail they receive from YCTV.
Sharing and Usage / Exporting
YCTV is the sole owner of all Customer PI and Consumer PI collected via YCTV and the www.YCTV.tv website.
YCTV does not share, sell, or rent any PI with third parties for their promotional use.
YCTV or Customer may use PI only as described above.
NOTE: YCTV’s Customers are not allowed to share the PI for Consumers who have opted in their distribution list(s) with any third party for any reason.
YCTV may use or disclose information, including Customer PI or Consumer PI, under the following very limited circumstances:
- In response to a subpoena, court order, or other legal process.
- To establish or exercise our legal rights or defend against legal claims.
- When YCTV believes such use or disclosure is (a) necessary in order to investigate, prevent, or take action regarding suspected illegal activities, fraud, or situations involving potential threats to the physical safety of any person, or (b) required by law.
- In the event of a merger, acquisition, consolidation, divestiture, or bankruptcy of YCTV.
NOTE: The YCTV service is not intended for children under 13, and YCTV does not knowingly collect information from children under the age of 13.
